GENERAL PROVISIONS

These general terms and conditions govern the relationship between CAPTAIN WILD (hereinafter the "Company"), a travel agency whose activity is subject to the provisions of articles L. 211-1 et seq. of the French Tourism Code, with the customer (hereinafter the "Customer") and the participants in the trip designated by the Customer within the framework of the organization of learning sports trips in the great outdoors in France and abroad (hereinafter the "Stays"), including equipment testing and supervised by qualified professionals related to the discipline, such as high mountain guides, specialized guides, or sports professionals, the subject of the present terms and conditions.

The contractual whole (hereinafter the "Contract") is made up of these General Terms and Conditions of Sale and the Sales Contract and documents relating to the services referred to in the previous paragraph and which have been given to the Customer.

All reservations imply the customer's unreserved acceptance of and full compliance with these terms and conditions.


COMPANY IDENTIFICATION

The Company is a SAS with a share capital of EUR 16,680, registered with the Annecy Trade and Companies Register under number 852 697 143, with its registered office at Route de la Bouvarde, Park Nord, 74370 Epagny Metz-Tessy (France).

Captain Wild has a financial guarantee from GROUPAMA Assurance-Crédit & Caution, an organization meeting the conditions set out in articles R. 211-26 and R. 211-29 of the French Tourism Code, located at 132, rue des trois Fontanot - 92000 Nanterre.

Captain Wild is insured under the Professional Liability Insurance n°145 987 966. Insurance company MMA, 14 boulevard Marie et Alexandre Oyon, 72030 Le Mans Cedex 09.

1- PURPOSE

From our website www.captainwild.com (hereinafter, the "Site"), we provide detailed information on the nature and specifics of each Stay. In particular, you will be able to consult the program day by day, practical information about the destination, and all the information you need to make your stay a success (level of physical involvement, minimum number of participants, etc.). We would like to draw your attention to the fact that our Stays may require a greater or lesser degree of physical commitment. We therefore recommend that you carefully read the information relating to the level of physical commitment required to undertake the proposed Stay. It is the responsibility of each Customer to determine, on the basis of the information provided, whether he or she has the necessary capabilities. In case of doubt, and prior to any registration, we invite you to contact Captain Wild and any specialist (e.g. attending physician in case of medical history) in order to validate your ability to undertake the proposed Stay.

The Conditions of Sale also specify the Company's cancellation and refund policy, any limitations on its liability towards Customers, and certain information relating to the Touring Services as a whole (risks, administrative and health formalities, payment and participation conditions, etc.).


2- PRE-CONTRACTUAL INFORMATION

In accordance with articles L. 211-8 and R. 211-4 of the French Tourism Code, the Company informs Customers by means of a Summary, prior to the validation of their reservation, of the main characteristics of the services offered relating to transport and the Stay, the contact details of the organizer, the price and payment terms, the conditions for cancelling and cancelling the reservation, information on insurance and the conditions for crossing borders.

In accordance with the provisions of article L. 211-9 of the French Tourism Code, the pre-contractual information communicated to Customers forms an integral part of the Contract and may not be modified, unless the Parties expressly agree otherwise.

The Company informs Customers of any changes to the pre-contractual information in a clear, comprehensible and visible manner prior to the conclusion of the Contract.


3- REGISTRATION

3.1 - Registration procedures

To register for one of our Stays, several options are available:

  • Directly on the Site: Choose your Stay, select the appropriate date, register on the site if you haven't already done so, fill in the requested information (including that of the participants you are registering), select the appropriate Cancellation Insurance criterion, select the appropriate Repatriation Assistance Insurance criterion. Then choose from the following payment options: Payment by credit card in 1 instalment, payment by credit card in 2 or 3 instalments via Alma (only available for amounts under 3500€), payment by Apple Pay or Google Pay, or payment by SEPA direct debit, and click on "validate and pay". Your place on the Stay will only be reserved once the full amount or the first instalment has been paid. Any bank charges related to this type of transaction remain the responsibility of the Customer.
  • By telephone and/or e-mail: You can also contact us by telephone to request a booking for a Stay. A Captain Wild consultant will take care of booking your Stay and will send you a payment link via our website or Stripe for a one-time payment. We do not accept payment in 2 instalments free of charge by telephone and/or e-mail. Any bank charges associated with this type of transaction are the responsibility of the customer.

For all registrations on the Site, the receipt of an e-mail from Captain Wild accompanied by an invoice confirms that the reservation request has been taken into account and that the totality or the deposit of the price of the Stay has been paid.

In accordance with art. L. 221-28 of the French Consumer Code, there is no right of withdrawal for the purchase of travel services. The balance of the tour price must be paid no later than 15 days before departure. Registration must be made in the full name of the traveler as it appears on the identity document used for the trip. It is the responsibility of each Customer to check that the first and last names on the travel documents (tickets, visa, etc.) correspond to those on the identity papers. In the event of non-conformity, you will not be entitled to any refund in the event of denied boarding.

3.2 - Accessibility / Capabilities

Our Stays require a greater or lesser degree of physical involvement, depending on the level of sport required, and are therefore not adaptable and/or accessible to all. We invite you to contact us for further information on the accessibility of our Stays.

In this context, the Company reserves the right to refuse registration to participants who do not meet the mandatory prerequisites. The Company and its professional staff reserve the right to refuse to accept a client who is not deemed suitable for one or more of the disciplines concerned. The departure will be cancelled or the discipline exchanged for an alternative whenever possible, without the customer being entitled to claim any compensation.

3.3 - Management

Stays offered by the Company are supervised by qualified professionals (such as mountain guides or sports professionals).

If it is not possible for a Stay to be supervised by the professional initially booked, the Company will replace him/her with a professional of equivalent competence.

The accompanying professional is the only one who can decide to modify the program initially planned, in particular to take account of weather conditions. The accompanying professional may, if necessary, propose an alternative itinerary; any additional costs incurred remain the responsibility of the Customer.

The customer is aware that he or she will not be permanently supervised by a qualified guide or supervisor.

3.4 - Content creation

Captain Wild offers equipment testing activities during stays with external partners. These partnerships may lead to the production of media content (photography and video) and feedback from customers following product tests. These activities must be communicated by Captain Wild before departure and clearly indicated in the logbook summarizing the entire Stay. By validating the "image rights" box in the logbook of the Stay, the Customer gives his or her rights to the use of his or her image and opinions by Captain Wild and the partners, as indicated in article 10.2 on image rights.

The Customer may legally decide not to give his/her image rights and/or to give his/her opinion on the products. It is sufficient not to tick the "image rights" box in the trip logbook, but the Customer will not be entitled to the content produced during the trip, nor to cancellation of the trip or even to request reimbursement or compensation. Captain Wild and its partners undertake not to broadcast any content presenting the Customer.

3.5 - Administrative and health formalities

Information on administrative and health formalities is provided by Captain Wild. It is the responsibility of each customer to ensure before departure that he/she complies with police, customs and health formalities (passport, visa, vaccination certificate) and to respect these formalities during the trip. This information is set out in the data sheet prior to registration. It may change according to changes in the country's administrative situation. It concerns French nationals.

For other nationalities, Captain Wild is at your disposal to assist you in your procedures. All costs relating to these procedures are at the customer's expense. No refund of the price of the trip will be made if the traveler is unable to depart due to non-compliance with these formalities.

3.6 - Minors

Tourist Services are not intended for minors, defined as persons under the age of eighteen (18).

The Company reserves the right to refuse the participation of any minor, as well as any person wishing to participate in Tourist Services, on the basis of their physical condition, or if the Company deems that there are any risks whatsoever to the safety and/or health of this person.

However, the Company may authorize the participation of minors in Tourist Services, where technical conditions allow and if they are accompanied by adults who are legally responsible for them (father, mother or guardian) for the entire duration of the Tourist Services concerned.

Where applicable, the Company's acceptance of a minor as a participant in Tourist Services shall in no way be construed as acceptance of responsibility for the minor in place of the minor's legal guardian Location .

If the participation of a minor is authorized, reservation requests concerning minors must therefore be made by the persons legally responsible for them (father, mother or guardian).

All bookings must be made exclusively by the person responsible for the minor, and must be preceded by the words "agreement of the father/mother/guardian [surname and first name] of [surname and first name of the minor]", as well as a handwritten declaration on honour.

In addition, the said person responsible for the minor must ensure that the minor meets all the conditions required for participation in the Touristic Services (such as age, required level, physical condition of the minor, possession of all required valid identity documents and completion of all administrative and health formalities, etc.).

3.7 - Security

It is the responsibility of each customer to take note of the safety instructions issued by the local authorities and the recommendations for travelers issued by the Ministry of Europe and Foreign Affairs (MEAE) on the website www.diplomatie.gouv.fr and respect them. As this information may change up to the date of departure, we strongly advise you to consult it regularly.


4- PRICES AND PAYMENT

4.1 - Price of the stay

All prices are given in euros, taxes included. What the price does and does not include is indicated in the technical data sheet, or logbook, for each Stay. The price of the Stay is indicated on the Site for each departure. The total price invoiced includes any additional services requested by the Customer. The total price of the Stay, including any supplements accepted, is communicated to the Customer and then mentioned on a new invoice.

4.2 - Price revision terms

The price of our Stays is firm, definitive and in euros. However, in accordance with article L211-12 of the French Tourism Code, the price may be adjusted upwards or downwards, up to 20 days before the departure date, without the possibility of cancellation/resolution on your part, due to one or other (or both) of the following price changes: - passenger transport resulting from the cost of fuel or other energy sources; - the level of taxes or fees on travel services included in the contract, imposed by a third party not directly involved in the execution of the contract, including tourist taxes, landing taxes or embarkation and disembarkation taxes at ports and airports. Any refusal on the part of the Customer(s) to pay this adjustment, provided that it is not significant, will be considered as a cancellation/rescission on the part of the Customer(s) and the cancellation/rescission fees set out in article 6.1 will apply.

4.3 - Terms of payment

You can pay the amounts to be paid for your Stay :

  • On the Site: The full price of the Stay by credit card. You will receive a confirmation invoice by e-mail.
  • On the Site: The full price of the Stay by Apple Pay or Google Pay. You will receive a confirmation invoice by e-mail.
  • On the site: Payment in 2 or 3 instalments by credit card using Alma (only available for amounts under €3500). The amounts debited and the due dates will be indicated on our site at the time of payment using the Alma Pay module. In the event of a dispute or non-payment of future debits, Alma will collect the amounts due. For more information, please visit https://almapay.com/fr-FR. Alma Pay is a French company. You will receive a confirmation invoice by e-mail.
  • On the Site: The full price of the Stay by bank transfer via SEPA. If your bank is equipped with an instant transfer module, the transfer will be immediate. If not, the transaction may take up to 7 days. If your bank refuses the transaction, we will be obliged to cancel your stay and release your place. We will offer you another means of payment to renew your booking.
  • Remotely by telephone and/or e-mail: The full price of the Stay by credit card. A Captain Wild consultant will send you a payment link by e-mail via our website or Stripe. You will receive a confirmation invoice by e-mail. You cannot pay in 2 installments by phone and/or e-mail.

Any bank charges related to these types of transactions remain the responsibility of the Customer.

Any delay in the payment of any sum in respect of your Stay by the due date may be considered as a cancellation/rescission on your part, for which the cancellation/rescission fees referred to in article 6.1 below will be applied.

In the event of registration less than 45 days before departure, the full price of the Stay must be paid at the time of registration. For all payments validated and cashed by Captain Wild, an invoice will be sent to the person who signed the registration form and/or validated the registration on the Site.


5- INSURANCE

The Company offers its customers the possibility of taking out cancellation and repatriation assistance insurance, at the time of payment for the holiday, through the insurance and brokerage companies KOALA and AVA. These insurances offer coverage adapted to the Stays offered.

 

Documentation relating to the general and special terms and conditions of the insurance policies taken out by KOALA and AVA insurance and brokerage companies is available on the Company's website under the heading Insurance.


6- CANCELLATION / MODIFICATION CONDITIONS

6.1 - Cancellation by the customer before the departure date

If you are obliged to cancel your Stay before its commencement (departure date), you must inform Captain Wild as soon as possible by any written means enabling you to obtain an acknowledgement of receipt. The date of issue of the written notice will be used as the cancellation date for invoicing cancellation fees.

In the event of cancellation of your Stay, excluding cruises and/or trips involving boat accommodation, cancellation charges will be applied in accordance with the provisions set out in this article and the following scale:

  • More than 60 days before departure: 25% of the total price of the stay, including VAT, excluding insurance,
  • From 60 to 46 days before departure: 30% of the total price of the Stay, including VAT, excluding insurance,
  • From 45 to 31 days: 50% of the total price of the Stay, excluding insurance,
  • From 30 days to departure date: 100% of the total price of the Stay, including VAT, excluding insurance,
  • In the event of a no-show on the day of departure: 100% of the total price of the stay, inclusive of tax, shown on the invoice.

In the event of cancellation of your Stay, including cruises and/or trips with boat accommodation, cancellation charges will be applied in accordance with the provisions set out in this article and the following scale:

  • More than 120 days before departure: 30% of the total price of the Stay, including VAT, excluding insurance,
  • From 120 to 46 days before departure: 60% of the total price of the Stay, including VAT, excluding insurance,
  • From 45 days to departure date: 100% of the total price of the Stay, including VAT, excluding insurance,
  • In the event of a no-show on the day of departure: 100% of the total price of the stay, inclusive of tax, shown on the invoice.

In order to avoid cancellation charges (under the conditions set out above, and excluding the cost of insurance and any deductible), you have the option of taking out cancellation insurance when you register for the Stay on the Site. Please refer to article 5 for further information.

The insurance premium, visa and passport fees are not refundable by Captain Wild or the insurer. Cancellation of the Stay does not exempt the client from paying the full price of the Stay; any procedure for reimbursement by the insurance company can only be initiated under this condition.

In the event of cancellation of the Tour by Captain Wild, for meteorological reasons, lack of participants, or other, the cancellation insurance fees are not refundable, neither by Captain Wild, nor by the insurance company KOALA. In the event of a change in the date of the Stay, the cancellation insurance taken out by the Customer is automatically transferred to the new date of the Stay, provided that the latter is identical in program and price.

 Attention: Captain Wild may, depending on the case, confirm a trip for which the number of participants has not been reached. In this case, once the trip has been confirmed, the customer who cancels will be subject to the general penalties. The fact that the minimum number of participants has not been reached does not entitle the Customer to cancel without charge. For example, for a trip with 10 participants, Captain Wild reserves the right to confirm the trip when only 7 participants are registered. In this case, cancellation fees will be charged for any cancellations made after confirmation.

In all cases, in the event of cancellation, for any reason whatsoever, expenses outside the trip subscribed to Captain Wild and incurred by the customer such as transportation costs to the place of departure of the trip and return home, costs of obtaining visas, vaccination costs, will not be reimbursed.

6.2 - Cancellation before the departure date by certain Customers and retention of the Stay for others

If one or more Clients registered on the same registration form cancel(s) their participation in a Stay maintained for the other participants, the following fees will be applied to the one(s) who cancel(s):

  • For personal services (not shared): the cancellation fee schedule in article 6.1 will be calculated for the Customer(s) who cancel(s) on the price of the personal services not consumed during the Stay on the date of cancellation,
  • For the shared services maintained for the participants of the Stay: a fee equal to 100%, regardless of the date of cancellation, will be charged to the participant(s) who cancel(s) on their share of the shared services of the Stay.

 

When several Customers are registered on the same reservation and one of them cancels his or her Stay, the cancellation fees are deducted from the sums collected by Captain Wild, regardless of who made the payment. For all cancellations, for any reason whatsoever, expenses incurred by the Customer(s) outside of the Stay subscribed to with Captain Wild, such as transportation costs to Location for the departure of the Stay and return home, costs of obtaining visas, travel documents, vaccination costs will not be reimbursed.

6.3 - Other services

After registration for the Stay and before the departure date, any request for modification (additions or deletions (extension, delayed return, change of accommodation....)) of services, can only occur with the prior agreement of Captain Wild and the payment to Captain Wild of the costs incurred, by all means with Captain Wild to allow collection. In the absence of payment, Captain Wild will not be obliged to proceed with the desired modifications.

From the date of departure, any request for modification and/or non-fulfilment of all or part of the services of the Stay will not give Location rise to any reimbursement of the initial services. Any new service requested during the Stay must be paid for in advance with Captain Wild or the designated service providers.

6.4 - Cancellation before the departure date in the case of a privatized stay

If one or more customers from a group that has booked a holiday cancels the holiday before it begins (departure date), the price of the holiday is non-refundable.

We therefore recommend taking out cancellation insurance for all clients in the group, or replacing the client(s) who cancel(s), with another participant who has the prerequisites to take part in the holiday. Captain Wild reserves the right to refuse a new participant who does not have the required level to take part in the trip.

If the entire group cancels the holiday, a cancellation fee will be charged to all customers in the group in accordance with the provisions of article 6.1.

6.5 - Assignment of contract

In accordance with article R.211-7 of the French Tourism Code, you have the option of transferring your contract to a transferee who meets the same conditions as you in order to carry out the Stay, as long as this contract has not produced any effect. You are required to inform Captain Wild of your decision by any means that will allow us to obtain an acknowledgement of receipt, and no later than seven days before the start of the holiday. In any event, the assignor and assignee are jointly and severally liable for payment of the price of the Stay.

In this context, the Company reserves the right to refuse registration to any transferee who does not meet the mandatory prerequisites set out in article 3.2. The Company and the supervising professionals reserve the right to refuse the departure of a Stay to a Client who is not deemed suitable in one or more of the disciplines concerned. The departure will be cancelled or the discipline exchanged for an alternative whenever possible, without the customer being entitled to claim any compensation.

6.6 - Gift card cancellation

Once you have purchased a gift card, you have 14 days in which to retract it. After this period, reimbursement is no longer possible and the card can be used on any stay on the site for a period of 2 years from the date of purchase.

If an order is cancelled with the use of a gift card, the amount of the gift card will be credited to a new gift card, but in no case will this give the right to a refund.


7- CAPTAIN WILD CANCELLATION POLICY

Captain Wild has the right to cancel the contract at any time, before the start of the Event. Apart from the refund of the stay, Captain Wild will not be liable for any additional compensation if the contract is terminated in the following two cases:

7.1 - Insufficient number of participants

The number of people registered for the trip or stay is less than the minimum number indicated in the contract. In this case, Captain Wild will notify the Customer by e-mail or by post of the cancellation of the contract within the period specified in the contract, according to the following schedule:

  • twenty days before the start of the trip or stay for trips lasting more than six days;
  • seven days before the start of the trip or stay for trips lasting between two and six days;
  • forty-eight hours before the start of the trip or stay for trips lasting no more than two days;

Captain Wild is prevented from executing the contract due to exceptional and unavoidable circumstances. In this case, Captain Wild will notify the traveler of the cancellation of the contract by e-mail or in writing as soon as possible before the start of the trip or stay. If the number of participants is less than the minimum number required, Captain Wild may offer to maintain the trip in exchange for a "small group" surcharge on the initial price. The possible extra cost of this "small group" formula will be communicated to the Customer, who may accept or refuse it. In the event of acceptance, this additional cost will be invoiced separately. This supplement will be reimbursed if other participants sign up for the trip before the departure date and the initial minimum number of travelers has been reached. In the event of refusal of the proposed surcharge, the customer's booking will be cancelled without charge and the sums previously paid will be refunded.

7.2 - Cancellation or modification of services due to exceptional and unavoidable circumstances

Captain Wild may have to modify the program of a Stay and/or cancel the Stay due to exceptional and unavoidable circumstances, and in particular for reasons related to maintaining the safety of Customers or due to the injunction of an administrative authority. In such a case, Captain Wild reserves the right to modify the dates, times or itineraries planned if it deems that the safety of the Customer cannot be guaranteed, without the Customer being able to claim any compensation, other than reimbursement for services not provided.


8- SPECIAL TERMS AND CONDITIONS APPLICABLE TO STAYS

8.1 - Documents supplied by Captain Wild

Before the departure date and after the payment of the totality of the price of the Stay, Captain Wild will send to the Customers, the following documents:

  • the trip guide, including a precise description of the stages of each day, the equipment required for the activity, and a summary of the services included in the price,
  • telephone numbers of useful local contacts.

Disclaimer: this guide is based on the latest information available at the time of writing. Nevertheless, imponderables and events beyond our control are always possible and may lead to changes on site.

8.2 - Insurance

Each Customer declares that he/she has been fully informed by Captain Wild of the fundamental importance of this coverage and of the absolute necessity of having it before departure. Consequently, Captain Wild cannot be held responsible if one or more Customer(s) has/have not taken out cancellation insurance, repatriation assistance insurance or has/have taken out an insufficient insurance agreement.


9- LIABILITY

9.1 - Professional liability

In accordance with the regulations of the profession, Captain Wild is insured for Professional Civil Liability by GROUPAMA Assurance-Crédit & Caution, an organization meeting the conditions set out in Articles R. 211-26 and R. 211-29 of the Tourism Code, located at 132, rue des trois Fontanot - 92000 Nanterre.

9.2 - Captain Wild's liability

Captain Wild cannot be held responsible for the consequences of the following events:

  • Loss or theft of tickets by the Customer(s)
  • Failure to present to the authorities and/or carriers (airlines, etc.) the administrative and/or health documents required to undertake the Stage and/or cross borders, in accordance with the information provided by Captain Wild,
  • Arrival after the scheduled time for check-in and/or boarding of any means of transport, in particular air transport, as well as for the Stay appointment. In this case, Captain Wild will not reimburse the cost of the transport ticket or the Stay,
  • Unforeseeable or unavoidable events of a third party such as: wars, political unrest, strikes outside Captain Wild, riots outside Captain Wild, technical or administrative incidents outside Captain Wild, airspace congestion, bad weather, delays (including in mail forwarding services...), breakdowns, loss or theft of luggage or other personal effects of Customers,
  • Cancellation imposed by exceptional and unavoidable circumstances, and/or for reasons related to maintaining the safety of the Customers, and/or injunction from an administrative authority: in this hypothesis, Captain Wild reserves the right to modify the dates, schedules or itineraries planned in order to ensure the safety of the Customers, without possible recourse from the latter.
  • Cancellation or repatriation assistance insurance taken out by the customer with an organization other than that proposed by Captain Wild,

In the event that Captain Wild's liability is called into play due to the actions of the service providers, the limits of compensation provided for by international conventions will be applied, in accordance with article L 211-17-IV of the French Tourism Code. Except in the case of personal injury, Captain Wild's maximum financial liability will be equal to three times the total price of the Stay. We remind you that the person who registers in the name and on behalf of the different Clients for the Holiday undertakes to transmit to each Client the information provided by Captain Wild concerning the trip so that Captain Wild cannot be held responsible for any defect or omission in the transmission of this information.

9.3 - Risks incurred

We would like to remind you that Captain Wild organizes "adventure" trips in natural terrain, which may be more or less remote from assistance infrastructures and in regions that are difficult to access. Each Customer must follow the advice given in the technical data sheets and by the guide-accompanier, or in the route book. Customers must be aware that they may run risks of all kinds due to local conditions (poor road conditions and means of communication, distance from medical centers, political or health situation, etc.). These risks are assumed with full knowledge of the facts. Captain Wild and the guide-accompanier reserve the right to exclude, at any time, one or more Clients whose behavior endangers the safety or well-being of the group, without any compensation being due to the Client.

9.4 - Transport before departure and on return from the Stay

For each Customer who organizes his own pre- and post-transportation services (transport...) to Location where the Stay begins and to your home on return from the Stay, Captain Wild recommends purchasing services (transport tickets and others...) that are modifiable and/or refundable and allowing reasonable transfer times between airports/ports/stations. In the event of an unforeseeable or unavoidable event caused by a third party or by the Customer, which would modify the services of the Stay subscribed with Captain Wild and/or would imply the modification of the services reserved by the Customer(s) (not included in your Stay), Captain Wild cannot be held to refund the induced expenses.


10- PERSONAL INFORMATION

10.1 - Personal information

The information you send us is recorded in a computerized file by Captain Wild, SAS registered with the RCS of Annecy under number 852 697 143, whose head office is located at Route de la Bouvarde, Park Nord, 74370 Epagny Metz-Tessy, in its capacity as data controller.

Certain information must be provided to Captain Wild SAS at the time of your request for the subscription of a Stay. If you do not provide this information, your request will unfortunately not be processed. The processing of your personal data is necessary to enable us to offer you the services of a contract for the provision of a tourist service. We would like to inform you that in order to execute your order for tourist services, your data will be communicated to Captain Wild's partners, suppliers of the services booked (hoteliers, transporters, guides, etc.) or technical service providers (IT, hosting, e-mail distribution, online payment service provider, etc.), who may be located outside the European Union.

Our company and/or partners undertake to use your personal data only to carry out certain tasks essential to the realization of your tourist service, in the strict respect of your rights as regards protection of the personal data and in accordance with the legislation in force. 10.2 - Image rights

We remind you that Captain Wild works with partners who may request the creation of media content (photography and video) during the Stay. This content is intended to be shared on the various communication channels (websites, social networks) of the partners, of the Customers who have made the Stay and of the Captain Wild Company.

By transmitting their testimonials and photos to the Company, Customers accept that this content may be used by the Company and the Stay's partners on all its communication media, without being able to claim any compensation in this respect.

In addition, during Sports Trips organized by the Company, in which Customers participate, the Company may take photographs and/or videos for subsequent promotional purposes. Customers who may appear in these photographs transfer their full image rights to the Company, without being able to claim any compensation in this respect.

Articles 226-1 to 226-8 of the French Civil Code state that "every individual has the right to respect for his private life, as well as the right to an image. right to image. By virtue of these provisions, it goes without saying that the publication or reproduction of an image (photograph or video) in which a person is easily recognizable is only authorized with his or her prior consent, whether or not the image is prejudicial. When the subject appears in a crowd (and is not clearly the central subject), whether from behind or from a distance, the rule does not apply.

In order to legally share or publish photos and/or videos, Captain Wild must request a document that must be signed by the person(s) concerned. This document must contain all the necessary information to identify the image concerned, as well as a specific authorization for the use to be made of it.


11- CLAIMS

11.1 - During the Stay

We invite you to contact Captain Wild if you notice any non-conformity in the provision of services during your Stay. In the event of a complaint, your failure to report any non-conformity in the provision of services during your Stay will, where applicable, be taken into account if it could have financial consequences.

11.2 - After the stay

Each customer has the right to make a complaint about the conditions under which the services of his or her Stay were provided in writing to Captain Wild SAS, Route de la Bouvarde, Park Nord, 74370 Epagny Metz-Tessy - as soon as possible after the return date of the Stay, accompanied by supporting documents. Failing a satisfactory response within a maximum of 60 days, the Customer may refer the matter to the Médiateur du Tourisme et du Voyage, whose contact details are as follows: MTV Médiation Tourisme Voyage - BP 80 303 - 75 823 Paris Cedex 17. 12- MODIFICATION OF SALES CONDITIONS

Captain Wild reserves the right to modify or update these conditions of sale at any time without notice. The current version is displayed on the Site. The version of the conditions of sale applicable to the reservation of the Stay is that in force on the day of the reservation.


13- CUSTOMER RIGHTS

The combination of Stay services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code.

You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. Captain Wild will be entirely responsible for the proper execution of the package as a whole.

In addition, as required by law, Captain Wild has protection to refund your payments and, if transportation is included in the package, to ensure your repatriation in the event of insolvency.
