1 - PREAMBLE

The present General Conditions of Use (hereinafter referred to as the "GCU") are intended to apply exclusively between Captain Wild and all persons wishing to access the Site and/or use the services offered from the Site (hereinafter referred to as the "User").

Any use of the services offered via the Site automatically implies the application of these GCU. Please read them carefully.

We hereby inform you that the provisions of these GCU are subject to change, in particular as a result of legislative and/or regulatory developments, without Captain Wild being held liable. The modifications will take effect upon their publication on the Site (unless otherwise indicated). The latest updated version will be available to all and permanently accessible on the Site, by clicking on the link "General Conditions of Use".

2 - LEGAL INFORMATION

The Company is a SAS with a share capital of EUR 16,680, registered with the Annecy Trade and Companies Register under number 852 697 143, with its registered office at Route de la Bouvarde, Park Nord, 74370 Epagny Metz-Tessy (France).

Captain Wild has a financial guarantee from GROUPAMA Assurance-Crédit & Caution, an organization meeting the conditions set out in articles R. 211-26 and R. 211-29 of the French Tourism Code, located at 132, rue des trois Fontanot - 92000 Nanterre.

Captain Wild is insured under the Professional Liability Insurance n°145 987 966. Insurance company MMA, 14 boulevard Marie et Alexandre Oyon, 72030 Le Mans Cedex 09.

Atout France registered as a travel and tourism operator under number IM069190020

3 - DEFINITION

The Site: designates the Captain Wild company's web site accessible from the address: www.captainwild.com.

User: any Internet user who browses and/or uses the services offered by Captain Wild from the Site.

Services: refers to all services offered by Captain Wild, i.e. Stays and associated services.

Customer: any Internet user who, after accessing the Site, (i) subscribes to the Newsletter, and/or (ii) requests a quote, and/or (iii) accepts a proposal for a Stay received from Captain Wild.

4 - USE OF THE SITE

The Site is accessible free of charge at Location by any User with Internet access. All costs incurred by the User in accessing the Services remain the User's responsibility. Likewise, Captain Wild cannot be held responsible for any Internet connection problem attributable to any equipment and/or operator used by the User (reduced speed or interrupted connection in particular).

From the Site, Users have access to the following information and/or Services:

  • A wide range of stays (free access for all Internet users),

  • Detailed information on the various products and services offered by Captain Wild (free access for all Internet users),

  • A specific access for firm or optional subscription to a Stay,

  • Access to a personalized area accessible to all customers with access codes.

5 - WARRANTY AND LIABILITY

Captain Wild will make its best efforts to allow access to the Site 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the control of Captain Wild and subject to any breakdowns and maintenance necessary for the proper functioning of the Site.

Indeed, for the good management of the Site, Captain Wild will be able at any time :

  • Suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or to certain parts of the Site,

  • Delete any information that could disrupt operation or contravene applicable regulations,

  • Suspend the Site in order to carry out updates.

Captain Wild cannot be held responsible in case of failure, breakdown, difficulty or interruption of operation, preventing access to the Site or to one of its functionalities.

The equipment used to connect to the Site remains the responsibility of the User, who must take all appropriate measures to protect his equipment and his own data, particularly in the event of viral attacks via the Internet. Captain Wild cannot be held responsible, the User remaining solely responsible for the websites and data consulted.

6 - GENERAL OBLIGATIONS OF THE SITE USER

The User undertakes to use the Site in accordance with the provisions of these GCU, public order and morality, respecting intellectual property rights and image rights. Should the User fail to comply with these provisions, Captain Wild may hold the User liable.

The User or the Customer shall keep secure any identifier and password enabling them to access the Site or any part thereof as strictly confidential, and shall not authorize any person to access and use such identifier and password.

The User or Customer is responsible for all activities related to the Services accessed or used via their customer area. They must immediately notify Captain Wild of any unauthorized use of their login and password by sending an e-mail to our Customer Relations department at the following address: hello@captainwild.com

By using the Services, the User and the Customer represent and warrant that (a) all information provided is true and accurate; (b) they maintain the accuracy of such information; (c) their use of the Service does not violate any applicable law or regulation.

7 - INTELLECTUAL PROPERTY

All content and materials on the Service, such as text, graphics, videos, audiovisual works, logos, photographs, icons, images, audio clips and software, are the property of Captain Wild or its licensors and are protected by French copyright laws and applicable international laws. Content and materials on the Site operated, licensed or controlled by Captain Wild may not be copied, except by a User solely for the User's personal use, and such content and materials may not be distributed, republished, uploaded, posted or transmitted in any way, without the prior written permission of Captain Wild. Modification or use of the content or materials for any other purpose would violate the intellectual property rights of Captain Wild and/or its licensors.

Captain Wild, and other Captain Wild trademarks and logos are registered trademarks and therefore the property of Captain Wild. Unauthorized use of these marks is prohibited by law. Nothing contained in the Service or the TOS should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on this Service without the specific prior written permission of Captain Wild for each use. The use of any Trademark as part of a link to or from any other website is prohibited without the prior written consent of Captain Wild.
